    In a way, it is like a gun law - the concealed carry permit. If you bust someone, and they are carrying without a permit, you have at least that.

    In this case, if you bust someone for cyber-harassment, and can't make it stick, (because of technicality or something) you still have ToS violation.

    Sorry, still sounds like too much to me ... those same "technicalities" , while working sometimes for a guilty party, also are what keep the authorities in check and our rights (mostly) intact
