Hi Guys

Myself and buddy Terry have just returned from the US to the UK after our 5/15/10 trip was cancelled.

We spent a couple of weeks diving down the Keys and around Boynton Beach area to make the best of a bad situation as our flights and vacation were already booked.

Hope everyone does not let this get to them too much, I know we are both very disappointed to say the least, but it's done and they are out of business. We lost over $3k on this and had to put our hands in our pockets for another $4k to cover the cost of the holiday we did have to cover meals, hire car, accommodation and day boats. (Still got in 24 dives!!)

I suppose I'm just posting to assure everyone else you are not alone, and that there are people from all over the US, Canada, and Europe who have been affected by a very disgusting owner.

I think Doug definitely has the ring of truth regarding Nekton. I would consider my husband and I to have been loyal supporters of Nekton, having done 3 trips with them. A couple of years ago we were actually getting ready to book a 4th trip and were considering another back-to-back, when a former employee stepped up and told me the truth about what was going on behind the scenes. Based on that information, we decided we couldn't support Nekton's business practices and haven't considered booking with them again.

The first shoe dropped a long time ago and the business was clearly limping along, the demise of the Pilot was the sound of the other shoe dropping, with the Rorqual being the final nail in the coffin.
 
Several weeks ago someone posted a link to a Webcam at Gulf County Shipbuilding’s yard, so from time to time I’ve been checking the site to see what kind of (if any) activity I could see on the “refitting” of the Pilot and/or the Rorqual… For weeks, I have seen absolutely no sign of activity on either boat; although I have seen some progress made on what appears to be the hull of a mono-hull boat they are building; that is until about 5 minutes ago!

Being dusk on the west coast of Florida, you can clearly see lights on onboard the Rorqual… I find it kind of odd that they close the doors on the business and then there are finally signs of activity on the boat!!! :confused:
 
Perhaps they are stripping everything of value out of the hull. The creditors will then only have the empty shells, and possibly the yard equipment left to squabble over. OR perhaps Mr. Dixon has discovered a new energy source fueled by the combination of rust, Black Mold spores, divemaster tears, and stale cookies. The Rorqual will be the worlds first bio-mechanical energy fuel cell SWATH ship! (but the A/C chillers and hot tub still won't fu-king work):)

a stripped hull would make it more attractive as sinking as a dive site.....

Well that is 21 x 2 x $1895 = $79,590.00 Dixon screwed out of your group alone! Not to beat a dead horse, but he sure has some bad karma headed his way!

Wow! I absolutely had not even thought about how much money he is making out of ALL the people he has screwed money out of. Thanks for pointing out that figure Doug. It opened my eyes to just how much he is getting away with. $80,000 just from this one group AND not paying employees. He HAS to be coming out sweet on all this. What a total shame!

And I also wanted to say kudos to Clay at EV! My husband and I love Explorer Ventures. We've been out with them 4 times and loved every trip! How very classy of you Clay to put that offer out to those who lost their trips with Nekton.

Someone else alluded to the fact that Uncle Sam is going to get his money first, and the rest of the creditors will be stuck fighting for the crumbs. As individuals we are all small (relatively, although it hurt our checking account like hell) fish compared to the other creditors he surely owes money to. But if we could get organized, such as (although I'm not sure it's exactly how to do it) a class action lawsuit, maybe we'd be a bigger fish and might stand a chance at getting a few crumbs. I know class action is not just a "snap your fingers" kind of thing; iirc a judge needs to rule that it's OK for multiple plaintiffs to form a class action suit.

Who are the legal eagles on the board? Anyone care to input? Would this work? Bueller? Bueller?
 
With the number of people posting here about cancelled and rescheduled trips has anyone been doing the addition? I'm sitting on the outside but it seems like there were more people scheduled for some of these now cancelled trips than there were spots on the boat even if it had been running. Just thinking here that if Nekton was double or triple booking (and by my count from reading through the thread it sounds like they were) to bring in some extra dough before shutting the doors that is a criminal matter not a civil one (fraud versus bankruptcy) and maybe some of you all should compare notes to see if that is the case.
