Correct, Doug. There were still 9 spots left on the May 15 trip when Dave Ostroot, one of Nekton's sales people, called me to encourage me to find people to fill them. Thank God I ignored him! There was no way I was selling more snowcones to Eskimos.
 
Thanks to everyone working with the CE II, including Mary, who fielded a couple nervous call from us over the past couple days! The wife and I are two of Paul522's six and with a little luck and on-time flights will be enjoying much bottom time in warm (and hopefully still oil-free) waters starting June 6. AND they're reserving a 100cuft tank for me! That's a big wOOT from your local neighborhood gashog!

I'm fortunate to be a member of another community of sports enthusiasts (not too hard to figure out what folks I'm talking about...) who are known for taking care of their own. I'm tickled to find that my wife and I are finding ourselves in a similar group as we continue our SCUBA careers. Even though one member of our little world has given us (and many others) a royal screwing, it's humbling to see how others have rallied to fill the gap. We'll be there when it's our turn to give back to the family.

Also, a BIG thanks to pseudocyber for his post about going to his bank and getting a refund. I did the same and my local branch is going to start working with the "claims center" or "reclamations bureau" or whatever to see if there is any help they can give. Nothing is set in stone yet, but when the local branch worker heard how much we lost to Nekton she said "wow, SOMETHING has to be available." I'll update the thread as I learn more. So, even if you paid 'em with a check, call 'em up and see what they can do.

You will enjoy diving with Exp Vent. They are a great company. I have been out with them several times and I went on the Nekton Rorqual last October. I would much rather be on the CEII than on the Rorqual as she was in October. Have fun on your trip!
 
I am not sure if it is possible to file a class action suit against the company at this time for loss of fees paid. I have worked on boats all of my adult life and had on two occasions had to file suit to be paid for back wages. One of the vessels I worked on, I actually had seized in Dutch Harbor. This is actually a fairly easy process if you have a legitimate claim. I just hired an attorney in Anchorage that looked over the claim. He was able to process the claim and we sent a Federal Marshal to Dutch that seized the vessel. Once the vessel was seized, the company had to post a bond to cover the costs of the claim and any additional expense that I had to incur to seize the vessel, plus a pile to cover unforeseen costs. It made them stand up and pay attention. In Alaska and I also believe in Washington the vessel crew has first right to any equity that the vessels or company has. I am not sure where in line a client that has lost money due to cancellation of their trips fall, but it sounds like there is enough in dollar value that you may end up with some return on your deposit. If you could do it as a class action you may even find an attorney to do it on percentage.

I paid Nekton $9011.20 for four of us to go to Media Reef on 5/29. Sooo angry, sad, frustrated, angry, sad.... Would have been second Nekton trip for two of us and first liveaboard for the other two. We are a nice family from Florida and Atlanta. Me, the mom, two of my sons and my daughter-in-law are out almost 10k!
 
We actually received an email from the newsletter writer for our scuba club. He was sending out a list of dive related news and that was one of the topics.

I was scheduled to be aboard on Jun 5th with my wife. We are out 4,500 dollars plus airfare. B of A says they cannot help us. No money to pick up with another live aboard, as we save all year to do a dive trip. We are sick!
