Why no gigantic fine (and/or confiscation of dive gear / boat)? Why no jail time? The actions were egregious and he'd been warned. He deserves more than a "permanent no-no." He's already proved that he doesn't care about "no-no"s.
 
In this article, the Warden goes all out to stop this illegal activities, freediving for evidence, etc. Warden Rojas sounds like “Batman” going after this “Joker”.
 
because this is california. anybody who breaks the law here is doing so because they had a disadvantaged upbringing due to systemic inequality and just needs restorative justice, not incarceration. /S

serious answer is that these are not serious enough crimes to be bothered to be prosecuted anymore as they likely were reclassed as misdemeanors under prop 47.
