If the articles is reflecting the truth, I have a problem understanding this statement in the text : "Basically there was a lot that the dive shop did incorrectly, and they ran a police investigation. "

Sounds more like poor Max tried to go behond his abilities. Nothing about diver #4, the european diver ?.
 
I am also intrigued by the same statement, what did the dive shop do incorrectly?
If the diver refused to follow the instruction from the guide and aborted the dive. There wasn't a lot the guide could do because he/she had other divers to consider.
 
Perhaps Max was signalled to "wait here", while the other diver was escorted to the surface and while waiting something strange happened?
 
again, where was diver # 4. The European diver?
