INTOVA ICOM problem

I just picked up a brand new Intova ICOM from a reputable eBay seller. Brand new in the package. I get batteries in it and turn it on. From a distance of about 3 feet shining on dark carpet, the light pattern appears to flicker intermittently between say 80-90-100% brightness. Does this seem normal or do you think I have a faulty LED? I noticed as I rotate the flashlight cylindrically in my hand, it effects the intermittent beam brightness.

Yep, definitely have a problem. When I tip the light upright, switch side down it shuts off, and flickers faintly in the glass housing where the bulb is.

Definitely somethings wrong. Can get the light to either flicker or turn off a number of ways. Rotating, a slight jostle, or tipping upright.
