Months ago I asked the dive community's assistance in getting a particular party fishing boat, the Freelance, to abide by the City of Avalon ordinance that prohibits vessels from anchoring within 300 feet of the dive park. The community responded fantastically and the Freelance, after checking with our Harbor Master on the regulations, agreed to abide with them. I am pleased to say that based on personal observations and reports from local boat operators, the Freelance has done just that. Thank you, Don.

However there have been other boats which have tested this (I assume knowingly). This weekend the "Sport King" anchored within 300 ft. I called the Harbor Master who sent a patrol boat out and the Sport King left the scene. Today the "Patriot" anchored at a distance I felt was within 300 ft of the park. The harbor patrol went out and felt they were an adequate distance away ("what does it matter if they are 250 or 300 ft away?" Well, because the ordinance specifically states 300 ft).

Given these two incidents, I would like to ask the SoCal dive community to keep an eye on party boats that are at anchor within 300 ft of the dive park (or fishing in other restricted areas such as the Lover's Cove or USC reserves) on Catalina. If possible take pictures or video of the encroachment with notes regarding what you observed and any actions taken. Witnesses names and contact info would also be useful.

I intend to maintain a collection of reports on such violations to present to our city council for strict enforcement. I feel our harbor master acts timely and fairly on such issues when they are reported. There are others who may not since they are fishermen and may be more sympathetic to these boats (we do have diving harbor dept. personnel and they are great).

I also plan to use such reports when the proposed marine reserves around Catalina are finally brought up for action under the Marine Life Protection Act. I feel the best evidence we have that marine reserves work is the fact that these charter fishing boats are fishing right outside (or even inside) their boundaries. Compelling evidence to refute their charges that marine reserves do not work IMHO.

Thanks again to all those who helped with the Freelance situation. They have shown themselves to be honorable. I hope the other boats will as well.

Just kidding. If I see anyone fishing close to the park or any reserve, my camera will be out. It's the best weapon I have.

I saw the Sport King Saturday...they were definitely way too close to the park. With miles of fishable shoreline, I don't see why they have to anchor right outside the park. Thanks for taking the time to alert the Harbor Master.
 
Yep, with 54 miles of coastline to fish and almost all of it unprotected, it is interesting that several (but not all) of these boats pick areas adjacent to official or de facto marine protected areas. I was talking to one of our local divers yesterday who actually watched a kelp bass hooked by a party boat fisher being reeled in... and it was well inside the park!

Sorry about the attacks you received from the fishers, Phil. I remember that. Just like with any "community" there are good and bad.

As most know, I have nothing against fishers who take legally for food but don't tolerate "sport" fishing or illegal fishing very well. Several of my buddies are spearfishers and I know they are knowledgeable and careful, and don't mind diving with them even when I'm filming.

My problem with these party fishing boats is two-fold: when they fish illegally in reserves or otherwise restricted areas (like the no anchor zone within 300 ft of the dive park), and due to the intensity of the fishing activity. Regarding the first, there are 54 miles of coastline around Catalina and most of it is open to fishing, why focus near the protected areas (we know the reason and they do too). Regarding the second, some boats carry as many as 90 fishers at a time. If they are fishing with that number, they can seriously deplete the fish stocks in a site quickly.

Is it legal to fish in Avalon Harbor? I see lines out all the time from moored boats.
 
Hey guys I was at the dive park this weekend but because of a cold I did not dive so my GF and I was fishing and watched our friends dive instead. Now that was my first trip to Catalina other then my certification dive. We were fishing on the jetty next to the dive park on the right side where the boats were anchored. Just for future reference is it legal to fish there? I only fished there because I saw a lot of other people fishing there.
 
Scubanimal and Raskal311... my understanding is that it is legal to fish from the Casino breakwater on the harbor side. When I see fishers casting into the dive park, I usually go out there and ask them to move to the other side. I'm not sure if it is legal to fish inside the harbor from a moored boat, but my guess is yes. You can fish from the Pleasure Pier or the Cabrillo Mole (where the boats come in).

Of course spear fishing is not allowed within city waters. They do allow it past Ring Rock (around the corner from Lover's Cove) to Pebbly Beach which I find interesting since that stretch is now incorporated into the City limits.
 
The reason they all want in that park is they want their customers to go home with some semblance of a catch. Waters are overfished, too many fishing boats, too many sushi bars and too many assaults on reserves around the world. Every fish safe area in the world is being threatened. Why would little ol casino point be any different? If you take the Black Sea Bass back off the no kill no catch warning list they will kill them all until you don't see another one. If we divers create an artificial reef to dive on and say fisherman stay away they will raid that too. Too many fishers too little fish. Pick up a camera and fight back. This is getting tiresome. Has anyone considered randomly placed mines around the edges of the park? Not only would it help protect the fish, but the occasional overzealous captain would provide us with new wrecks to dive...
