You can find some good tracks at www.emusic.com It requires a monthly subscription.

Of course, if planning to commercialise the DVD you need to get permission from the artist or publisher.

I use emusic and tracks from CDs if the audience will only ever be family and friends and I create it myself using music loops and Soundtrack Pro if I plan to sell the DVD.

When making my diving videos I use music from www.stock20.com you pay $7 per song and for your 7 bucks you usually get around 8 versions of the track, 15sec, 30sec, 1 min, 2 min & 3 min versions. There is loads to choose from and you get the licensing and everything.

I think this is really neat how the members of this Scubaboard are educating divers and video makers on how to stay legal with copyright laws, in this case, music. This is such a misunderstood subject.

I have licensed a lot of music for film and odd projects such as a motorola MP3 player that I pre-embedded music on prior to shipping. Legally there are multiple things you have to do only IF you are going to profit off of the video with the music in it.

You need to obtain 2 different types of rights.

1. Sync Rights
2. Recording Rights

If you are going to use an original recording performed by the song's writer you need both. If you are going to use a song not performed by the writer, such as a cover song, you just need the sync rights from the writer/publishing company, but may also need to obtain the recording rights if you were not the one that paid for the performer(s), i.e. studio musicians, to go into the studio and record the song.


If you want to cover your butt you can go after something called a Gratis Mechanical License. I just currently did one of these with a band who's song I wanted featured in lmy last short film. What that is, is a DRM (digital rights management) and royalty free license issued by the artist and the publishing company. They will usually only do this if you present a contract that states what the film/video will be used for and that it is a not for profit endeavor. If you're interested I can send you examples of this. This is also the type of license that I used for the MP3 player I worked on.

Remember (and I may get heat for this) unless your making money off of your visual work, this is all completely unnecessary.

Another great place to find music to purchase is iTunes. Apple's database is huge and you can find everything that would fit your needs.
