Diver0001 raises a good point. While actually pulling a reg from the mouth of someone legally filming them is not beyond some local bruddahs, staging a false-flag "assault" is certainly not beyond some latte-sipping save the oceans crusaders I've met here, too.

Don't knock the Mocha Latte :)

But i look at is this way -- one or both sides are going to get charged with something....

There are lines that shouldn't be crossed on any side.. especially if you're 50' down...
 
ALSO...........could that be a Scuba Police(man) from Cozumel vacationing in Hawaii???......----------nah, couldn't be....:)

No, this is not a comparative fault issue. Assuming all permit/other regs are followed, collectors have the right to go down there and collect as many reef critters as they can; others have the right to swim around and film them. The only line that was crossed, assuming the confrontation is genuine, was engaging another diver because of (a) annoyance at having their collecting made harder by the presence of extra divers/bubbles (unlikely, given how messy their own swimming and bubbleblowing was), or (b) annoyance at being recorded.

If a collector feels "harassed" they're welcome to file a complaint, but even under Florida rules I think you'd have a hard time making out a claim for self defense using deadly force in the context shown by the video. In Hawaii, where (unless you're a cop) you'd better be a good, passive little unarmed peasant...good luck with that claim.

Im a fairly new diver, but i cant believe these kind of people are out there. what kind of scum does it take to attack someone 50Ft. down that could end up killing someone?! granted me and my friends fool around with pulling fins and regs out of our mouths on our DC stop as our twisted way of keeping our skills sharp. but this was completely malicious and deliberate. i think they should revoke this guys C-card and charge him with some degree of attempted muder or assault with a deadly weapon. i have not been able to dive in hawaii, but im sure there are fines like anywhere else for damage of the coral. do you think this is may be why they tried to assault the diver filming? from the video i saw, the purpatrator was banging around on the coral like a trampoline.
