Ummmm, Gee - If sirius did not activate it after it was reported stolen, they would not be selling very well on E-Bay...

This is the part that gets me:

Sirius admits they only mark a radio as stolen if a customer goes thru a two step process. First, the customer must report it to the police. Second, the police have to subpoena the company's records.

Huh?

I especially can't understand why the police need to subpoena company records. A copy of the official police report should be sufficient.

It would be like your insurance company refusing to cover you for your stolen car unless the police subpoena their records too
