Easiest way to get the live animal out of the shell would be to make a hole in the shell with a machete or heavy dive knife etc.
 
why is it illegal to take conch shells, I understand why the live ones, but if the shell is empty?
 
Very often an empty shell is not as beautiful as one that was alive until you found it. So there are people and collectors which kill the live conch just to obtain a nice and shiny shell.
