After visiting Honolulu & Kauai last November, I can totally understand people on Kauai not wanting it easier to get there. Kauai is a beautiful place that is not overpopulated. Honolulu is the opposite. As a tourist, this ferry would have helped me a ton and saved me a lot of money. There doesn't seem to be a legal argument against the ferry, but if I lived in Kauai I would hate the ferry going there. Lets all hope it doesn't change Kauai from the beautiful place it is now.
