No, he's not. That would be like putting your chips on thirteen, having the ball land on double-zero, and asking for your 35-to-1 payout.

He just wants to apply the trip insurance to a later date. Thats not a losing bet.
Yes, that's a losing bet. The bet he made was defined something like this:
If the trip to Mexico that I booked for May 2nd has to be canceled for medical reasons, death of a close relative, or an act of god, DAN will pay me the insured amount. If not, DAN will keep the premium I paid.

If you're in the mood to argue, you can claim that a flu outbreak qualifies as an "act of god," but I promise you that the terms of the contract are all narrowly and precisely defined. And I doubt they include hysteria over a flu outbreak.

Hysteria or not, that's our CDC for ya. I don't think ignoring their warnings imprudent. But a contract is a contract and DAN has the leverage there.
 
CDC was in a different position from WHO. The pandenic phases do not take into consideration the severity of cases in the outbreak - only the rate of spread. Thus far, we have a high rate of spread of a lowseverity virus. Use common sense: travel is OK.
 
As an aside, my dry cleaner scanned me for fever yesterday before he would accept my laundry. How's that for hysteria?
 
I can't be Rickrolled, Don. I am Rickroll-proof because I am a huge Rick Astley fan. I have all his albums, a poster of him hanging on my wall, and a continous loop of his videos playing on a big-screen tv at all times. I wear a trench coat and hipster shades whenever I go outside. :wink:
 
Guess you have to read what you are actually buying because like everyone else out there the fint print will get you. Do I think its too much to ask from DAN insurance to accomidate you because of the swine flu outbreak or whatever you want to call it , NO I DONT. The OP simply stated that he wanted to make arrangements to take this trip when things were a little safer and he had to "jump through hoops" as he said. Bottom line is he didnt want to cancle because he didnt feel like going, he had a valid point no matter what way you look at it.
 
In the "General Exclusions" section of the policy, it states: "This plan does not cover any insured Loss caused by or resulting from . . . any Trip taken outside the advice of a Physician." In other words, if a physician advises against making the trip, and you, the insured, decide to make it anyway, you are not covered, and the insurer will not pay.

In this case, both national and world health agency physicians advised not to make such a trip. Additionally, I am willing to bet you that not one person's personal physician would advise in favor of making this trip during the current outbreak. Would yours have told you to make the trip under the circumstances?

Given this situation, the insurer should have provided coverage in the event that I would have needed to rely on this. It isn't fair that the insurer should profit from premiums while retaining the right to deny coverage due to a policy exclusion (travel against advise of a physician) on the one hand while stating that a "mere" national and world health travel advisory is not sufficient to trigger coverage on the other hand. Does that seem fair to you?

It just doesn't seem right to me that a medical organization,DAN, should ally itself with a position that forces its paying members to have to decide to risk contracting a serious illness in this way. So, I decided to do something about it by bringing this to your attention, and by giving you a vehicle to potentially correct the situation.

No matter how you feel about the situation, DAN has indicated that it would consider revising future policies to provide coverage in such an instance. If enough members voice their opinions, perhaps we can prevent someone from contracting a serious illness (or worse) after making a pressured decision to make such a trip in the future.
