One thing becomes clear from this: We need to make this site a marine sanctuary.
Instead of posting here we should be pestering the County Commissioners with letters, and getting our local representatives involved.

Would that prevent the taking of fish? The site is immediately adjacent to (and overlaps really) a designated fishing pier. Does a sanctuary work where hook and line fishing is promoted? From what I understand of the proposals, there would be no restriction on fishing.

I think people's efforts would be more useful if they were directed at determining the source of the frequent sewage contamination episodes and possibly trying to get the county to address the source of the contamination issue. People seem to be worked up over a single fish taken from what is essentially a designated fishing area. There are much bigger issues there.

Now read it broken down into the meaning of the definition. Hope that helps some to understand that

"The catching or taking of a fish through the instrumentality of a hand propelled single spear (knife), barbed or barbless, operated by a person swimming at or below the surface of the water" is defined by FWC as "Spearfishing"

Soo. If fishing from the pier is ok, should spearfishing be ok. Not sure what you're getting at. You speared (ok, stabbed) the flatfish in a no spear zone, right?

As a sanctuary I believe all but the most brazen violators would be mitigated. As with Pennekamp. There is such a public awareness, the poachers go elsewhere (IMO).

There is no 100 yard zone around a fishing pier that precludes spearing. It is not a "no-spear zone",(again, according to FWC staff).

Only spearfishing is prohibited in that 100 yard zone.

I question the desirability of designating an area "a santuary" when numerous people are going to be hook and line fishing in it.

You are missing it.

If you spear while in or under the water, you are spearfishing. I was in the FWC office yesterday. They had the video. There is a violation. FWC is taking action.

As to your comments about the sanctuary, I may be wrong but I think you are deflecting and attempting to muddy the waters. I know from your posts you do not support the sanctuary. One thing the officer told me which I will share; There were lot's more than "dozens" who called. Most were calling to support the sanctuary. The ones that FWC could respond to were the ones about spearing at the pier.

Again...your post did did more to draw attention to the BHB than Scubadiving magazine did.

I will say one more time. I spoke to the district Captain at FWC. He (and upper management who deferred it to him) saw the video. It is a violation and is under investigation.

With whom did you speak?
 
Splitlip - your efforts are commendable, but I think you can stop wasting your time arguing with Dumpster. He broke the law. He knows he broke the law. He doesn't care because he thinks it's a stupid law so he shouldn't have to obey it. He gets off on the idea that he is irritating people who disagree with him, so arguing with him only makes him feel more important.

There is nothing anyone can say or do that will change his attitude on this issue.
