When I looked up the case, I found That Brad Horn's company was indeed hired to provide an analysis where Brad's company appears to blame the rebreather. The clerk tells me it will take 3 days to make the trial transcripts available. I'm curious to see why Brad's company says the rebreather at fault yet the court apparently disagreed and judged for the defendant.

I'm just a newbie OC rec diver, but I find the topic of rebreathers very interesting. However, in looking up the APOC O2 ccr unit mentioned here, I see this on the spec sheet:

Why would anyone want to use an O2 rebreather like this for diving if it limits you to 20 feet max depth and 45 minutes max dive time? That seems like a pretty useless tool when OC scuba would allow you to go much deeper (and much longer, esp. at 20 feet)? I don't get the usefulness of this product???

Normally I stay out of this stuff, but when I see 'BRAD HORN ON ANYTHING' as a major thread title on the biggest dive forum, I swallow the vomit and pull up the chair.

That troll has not only cost a lot of good people some very real money, but some plaintiffs their cases. He does so badly on the stand that he should be hired for the defendants.

Doesn't matter, the APOC is vaporware. O2 rebreathers like the Draeger LAR V is used by special forces for a number of different missions. In 20 feet of water.

Yep that sucks. Printed transcripts are available for free. I've requested them from the clerk and I'm told it will take up to 3 days.

I'm not in this fight other than to say that the rebreather you're discussing comes without a control system and as-is can be used as an oxygen rebreather. However it's clearly intended to have user fitted electronics installed to then be used as a mixed gas rebreather. That apparently is the way that the users have been operating them. So the "oxygen rebreather" name is a red herring.

I've read the medical examiner's actual complete report. Remember that any accident
is never one single contributing cause but rather a chain of contributing causes in a line that yields a final outcome. Don't focus on one contributing cause. When you read the M.E.'s report you'll understand the verdict.

What I haven't seen yet is "Was there a judgement/agreement for the wife and kids to pay the defense's attorney fees?"

I believe that the defendant's attorney has asked for somewhere on the order of $750k. I do know that in the case of Dewolf V Kohler, which was litigated by the same defense attorney, the court found that it was in fact a frivolous lawsuit and found for the defense. I don't think you can get blood from a stone however.
