my instructor told me that anytime you open your mouth and exhibit "expertise" you open yourself up to liability. His example was that if you are climbing and see someone setting up an unsafe anchor, if you tell them what they are doing is unsafe and "instruct" them to correct it, if they ignore you and fall, you MAY be open to liability for not ensuring they re-did it or alternately, if they re-work the anchor and it fails for whatever reason, again you MAY be liable for offering advise in the first place.

It came down to more of a moral imperative to look out for the stupid but caution the way you approach correcting the situation.
