What critter is this?

What kind of snake is this? (see pic)

When we walked up to it, it's "neck" hooded up like a cobra, which really surprised me. It the pic, it's showing it's hood some, but not as much as it did at first.

It was about 3 feet long. It had no "rattles" (that we could see/hear)

I saw this on a dive trip this past weekend about 200 yards from the beach on a side road off Hwy 30a (between Destin and Panama City).

Color may vary quite a bit. So if you look it up don't be surprised to se much darker specimens in pictures. They rarely bite. If you try to right one that is playing dead it will just roll over again and stick it's tongue back out.
