Or the victim could have just retrieved the regulator.

Not saying it's not wrong, but it's only fatal if the skills taught in Open Water are too rusty to use.

Yes it was assault and an assault in which the person assaulting knew he could kill the woman. If the reg is pulled exactly at the moment when you are inhaling you will take in water. This clown needs to be identified and put behind bars.

Apparently this diver had over 10,000 dives and is part of the Sea Shepard group. She should of realized that the fish collector was up to no good based on how fast he was swimming up to her. Besides being under water with obvious hazards what man attacks a woman and gets away with it. Its still assault. IMO its attempted murder as the end result could of been much worse.
