After review of the photo, I would have to say that it was improper placement of the tow line to the flag which caused it to skew at an angle to the water thus improperly displaying.

On the flip side, this is an excellent demonstration of how boaters all around the US seem to think that it is their right of way no matter what.

Oh... the last observation is that it appears the tractor had not made it to reef level yet, though that could occur the next time this vessel nears a dive flag.... there might be a MINE TIED TO IT :)
 
Wow !!! That don't look good at all.
 
You can always carry several plastic grocery bags in a pocket.
If a boat is close like this just let the bags loose near the water intakes.

This also works to quiet noisy generators in a gathering of boats. :D
 
Each state has its own laws regarding the alpha flag (dive flag). Someone already went to the trouble to look them up:

There's a no wake zone or slower than 5 mph within 100 feet of the flag. So, aside from gross negligence and a blatant disregard for human life, if they weren’t throwing a wake they were ok.

Is boating season still open in Alaska? If so maybe it’s time to apply for your barge tag…

That's why they were upset that our flag wasn't farther out - made it more difficult to maneuver around. These docking barges keep power to the screws in order to maintain contact with the boat ramp. This obviously screws up our viz - but the upside is - this time of year when the "stuff" has all died off, there's enough floaties for mid-water reference for at least a couple hours!
