Filmmaker Rob Stewart's family files wrongful death lawsuit

Are you thinking that Rob was certified to that depth? Or were you thinking other things, like Rob had been warned by other people not to take it so fast? Or that maybe that Rob was just diving beyond his limits. Or that sometimes bad things happen to folks you wish it hadn't?

OK so I have been following this thread because as an instructor I would want to avoid the situation that lead to sad outcome. I believe that:
a. Rob had a newly minted cert card to dive to those depths,
b. Rob lacked the experience to understand the risks of that given dive,
c. Sotis may or may not have rushed the training in order to meet some timeline (just based on internet speculation) and;
d. divers die doing what they do. Not always is it someones fault.

Maybe you were thinking that someone in Key Largo has a huge beef with Peter Sotis. A business beef, perhaps, and might say all kinds of things to make him look particularly bad if there were a pending business lawsuit, including some Libyan connection, restamping cylinders not in accordance with DOT, lots of things. Maybe you weren't thinking that at all.

Peter Sotis was smart enough to hire a top notch dive lawyer.

I think things are better in Canada where civil cases are argued in front of, and decided by judges, who understand the points of law.

There was a legal movement that started in the 60s that judges shouldn't have a significant role in throwing out terrible cases, they all deserve to go to the jury. With that and joint and several liability, plantifs are allowed to present cases that have no factual bases but have an emotional hook and result in enormous verdicts.

It would be nice if juries could determine that some lawsuits are asinine and not only clear the defendant but fine the plaintiff and counsel for all defendant legal fees and court costs.

The juries might have been influenced by what they had read etc etc and could not readily distinguish black and white. And how about marginal cases?
