Kind of ridiculous to point fingers though at the person who sold the dry suit though. I get the concept and I hope that person is removed from the list of defendants with minimal cost. I don't think it is an unreasonable assumption to think that when selling a dry suit to an instructor who contacted you, that the instructor would train them properly to use it.
Huh. I have a dry suit, dived it a number of times, don’t really like it, but don’t have a dry suit card. I have a really nice DPV. A Sierra. Don’t have a card. I’ve sold a number of regulators to people I have no idea who they are. I may be a scuba instructor, but I’m not a big fan of requiring training for every piece of equipment you want to buy. OTOH, I wouldn’t put a diver with 5 dives in a dry suit. I also wouldn’t put a diver with 4 dives in 2 wetsuits in Seeley lake either.

I should have added for such an inexperienced student.
 
I don't think that there should be any expectation for someone that is selling used scuba gear to vet who they are selling to. Not when I can order every piece of gear from an online seller and have it delivered to my door no questions asked.

But the legal climate means anyone and everyone gets sued.

I'm not talking about random people buying gear from me. I've never vetted anyone I've sold to. I'm talking about this particular case.
 
Google "right to be forgotten"
The person may have the right to be forgotten (private information removed from the web) but PADI or state licensing boards or other entities are the holders of this corporate data which makes it private on only one side.
 
No one will open any shop selling anything if they are responsible for the buyer subsequent usage of the item bought from them eg. car, gun etc etc.

Not out of line at all. But does that expectation rise to negligent liability? If a dive shop can be sued for providing gear that failed on a dive resulting in a fatality, are you safe selling your gear to a stranger?

Considering that you can be sued at anytime for any reason, no you aren't safe. You really should get a liability waiver ideally written by a lawyer, but making it clear that it is sold as is, and that getting the gear inspected along with the knowledge how to use it is entirely on them.

Though how many used scuba gear sellers require that type of waiver, so far both buying and selling my number is zero. Though thinking now I probably should do it from now on. I put the warning that it should be serviced before use on my sale posts, but I really should have a signed waiver.
