I've given up worrying about liability issues one way or another. These days anybody can sue anybody for anything. I've heard urban legends (dunno if they're true or not) about instructors being named in lawsuits just because they were on the boat! They weren't diving with, around or near the person that got hurt and yet they still got named in the suit. It sounds bogus, but then again so did that, "My hot coffee burned me so I'm suing McDonalds for making hot coffee hot" law suit too! I guess that's what insurance is for, right?

the McDOnald's award got reduced by the judge... i belive McDonald's then settled for a much smaller sum

ok, here we go:

jury handed out $160,000 for actual damages
jury handed out $2.7 million in punitive damages
judge reduced punitive damages to $480,000

(total award to this point is $640,000)

McDonalds then settled out of court instead of going on to appeal the case.
they settled at something less than $640,000, but no one knows the amount.

here's an interesting perspective (from a lawyer, of course):

I show the lowest level of card that lets me do what I want.

All the best, James

I show my instructor card

there's no reason to call any attention to yourself

i would do this too if i had a pro rating

I just show my AOW card unless my daughter is with me. Because shes 12 we have had some hassles so I then show my instructor card. From what I've seen shes a much better diver than alot of folks at the resorts.

Ditto.

But not likely to be facing that problem soon, although I'm considering going for DM...
